What the Law Says

Property law in India is governed by the Transfer of Property Act, 1882, the Registration Act, 1908, the Specific Relief Act, 1963 and the Real Estate (Regulation and Development) Act, 2016 (RERA).

In Delhi NCR, different areas are governed by different authorities — DDA, NDMC, MCD, Haryana RERA, UP RERA — each with distinct rules on permitted use, conversion charges and building regulations. Title to property in Delhi is particularly complex given the legacy of DDA allotments, colony regularisations, and the presence of both freehold and leasehold land.

What documents should I verify before buying property in Delhi?+
At minimum: (1) Sale deed chain for at least 30 years confirming unbroken ownership; (2) Encumbrance certificate confirming no mortgage or charge; (3) Revenue records confirming possession; (4) Mutation entries in municipal records; (5) Approved building plan from MCD/DDA; (6) Occupancy Certificate; (7) NOC from housing society if applicable. Never rely on the seller's self-declared documents — always verify originals independently.
The builder has delayed my flat by 3 years. What can I do?+
Under RERA you have three remedies: (1) Continue with the project and claim interest at RERA rate on all payments made for the entire delay period; (2) Withdraw and claim full refund plus interest; (3) Claim compensation for other losses. RERA proceedings are faster than civil courts — builders are frequently ordered to refund with interest within 6–12 months.
Can my landlord evict me without going to court?+
No. Forcible eviction — cutting electricity, locking out, removing belongings — is illegal and criminal. Eviction requires a court order. In Delhi, rent-controlled tenants (rent below ₹3,500/month) have very strong protection and can only be evicted on specific statutory grounds. For non-rent-controlled properties, the landlord can seek eviction through civil courts after the tenancy expires.
How do I claim my share of ancestral property?+
Every coparcener — son or daughter equally, post the 2005 Amendment confirmed by the Supreme Court in 2020 — has an absolute right to demand partition of ancestral property. File a partition suit in Civil Court. If other family members are attempting to alienate the property before partition, an emergency injunction can freeze the property pending the suit.
