What the Law Says

Family law in India is personal law — applicable differently based on religion. Hindus (including Sikhs, Jains and Buddhists) are governed by the Hindu Marriage Act, 1955. The Special Marriage Act, 1954 governs inter-religion marriages. The Protection of Women from Domestic Violence Act, 2005 provides civil and criminal remedies across religious communities.

Child custody is decided on the paramount principle of the welfare of the child — not the rights of either parent. NRI matrimonial disputes present special complexity: divorces obtained abroad, custody enforcement across borders, and maintenance enforcement in foreign jurisdictions require specialised handling at the intersection of Indian and international private law.

What is the difference between mutual consent and contested divorce?+
In mutual consent divorce, both parties agree and settle all matters by agreement — typically concluded in 6–18 months. Contested divorce is filed by one party on a statutory ground over the other's objection — a full trial that can take 5–10 years. The choice should be driven by the specific facts and the other party's willingness to cooperate.
Who gets custody of the children?+
Indian courts decide custody based on the welfare of the child — the paramount consideration. Courts weigh the child's age, preferences (given more weight as they grow older), each parent's ability to provide financially and emotionally, and stability of living arrangements. Joint custody is increasingly common. Interim custody can be sought urgently if there is a genuine threat to the child's welfare.
My husband is an NRI and has filed for divorce abroad. What should I do?+
Act immediately. Once a foreign court assumes jurisdiction, challenging it becomes progressively harder. File for maintenance under BNSS in India immediately to secure financial support. Obtain advice on whether to contest the foreign court's jurisdiction. If there is a risk of children being taken abroad, apply for their passport impoundment urgently. Indian courts have consistently protected Indian wives from unilateral foreign divorces.
What maintenance am I entitled to?+
There is no fixed formula — courts consider the husband's income and assets, the wife's income and needs, the standard of living during the marriage and the number and ages of children. In Delhi, interim maintenance for middle-class families is typically ₹15,000–₹50,000 per month but can be substantially higher where the husband's income is significant. Interim maintenance is usually awarded within 2–3 months of filing.
